Israel’s Presence in the West Bank Violates No International Laws

The American decision to abstain from voting on the UN’s recent condemnation of Israeli settlements was, writes Mark Goldfeder, “the cowardly move of a lame-duck politician” intent on taking “a symbolic parting shot at Prime Minister Benjamin Netanyahu and President-elect Donald Trump.” Concerning the widely held notion that Israeli settlements violate international law, Goldfeder comments:

In 1922 the League of Nations Mandate for Palestine established an area (which included the West Bank) to be a national home for the Jewish people. Article 6 of the mandate explicitly encouraged “close settlement by Jews on the land.” . . . [U]nder the international legal principle of Uti possidetis juris, . . . emerging states presumptively inherit their pre-independence administrative boundaries, and thus international law clearly dictates that Israel [would] inherit the boundaries of the Mandate of Palestine as they existed in May 1948. Israel thus has title to the land. . . .

If there was ever an [illegal] occupation of Palestinian territory, it happened between 1948 and 1967, when two of the invading Arab armies, Jordan (West Bank) and Egypt (Gaza Strip) occupied territory that they had taken through aggressive action—the kind of aggressive action that the new [Security Council] resolution explicitly reminds us is forbidden under international law. This was, of course, territory that was part of the Mandate for Palestine and therefore rightfully under Israeli title. . . . The [pre-1967] Green Line was drawn for no other reason than to mark off on a map how far the two invading armies had managed to get. The armistice agreements themselves state that these were not ever meant to be actual borders. Thus to give meaning under international law to these “pre-1967 lines” is, ironically, to ratify retroactively aggression against the mandate and to support occupation. . . .

As [Israel’s seizure of these areas during the Six-Day War] was the only defensive re-conquest of previously occupied territory that has ever happened under the UN charter, one might be forgiven for wondering if the law on this point is somewhat murky, but it is not; . . . pre-1967 sources evidence the fact that defensive conquest would be considered legitimate, but the truth is that even if the law was somehow gray in this area, one of the clearest doctrines of international law is the Lotus principle, which says that sovereign states may act in any way they wish so long as they do not contravene an explicit prohibition. [In other words], if there is no law against it—and there is no law against defensive re-conquest—then it is legal under international law. . . .

[This] is not to say that on a political level the settlement issue is at all clear-cut. It is certainly true that the areas in question are disputed territory, and that “settlements are one of the obstacles to peace” in the sense that it would be helpful for the negotiations (at least for one side) if Israel would stop.

But it is also true that there is no consensus on what other “obstacles” there are, or how many there are, or how much of an “obstacle” the settlements are, or why only Israeli and not Palestinian settlements, and whether the Israeli settlements, which actually cover only 1.7 percent of the disputed West Bank territory, are in fact a necessary bargaining chip for Israel to hold when dealing with an opponent that still refuses to recognize its very right to exist.

The triumph of Chanukah

BECAUSE CHANUKAH usually occurs in December, it is sometimes thought of as the "Jewish Christmas." It isn't, of course. And yet it is fair to say that the reason for Chanukah's popularity — especially in America, where it is the most widely observed Jewish holiday after Passover and Yom Kippur — is precisely its proximity to Christmas.

Chanukah used to be regarded as a minor half-holiday, cheerful but low-key. It has become something bigger and brighter in response to Christmas, which transforms each December into a brilliant winter festival of parties, decorations, and music. Attracted by the joy of the season, not wanting their children to feel left out of all the merriment and gift-giving, American Jews in the 20th century began to make much more of Chanukah than their grandparents ever had. Today Chanukah is well established as part of the annual "holiday season," complete with parties, decorations, and music of its own. Its enhanced status is a tribute both to the assimilating tug of America's majority culture and to the remarkable openness of that culture to Jewish customs and belief.

Ironically, Chanukah was established to commemorate the very opposite of cultural assimilation. It dates back nearly 22 centuries, to the successful Jewish revolt against Antiochus IV, one of the line of Syrian-Greek monarchs who ruled the northern branch of Alexander the Great's collapsed empire. Alexander had been respectful of the Jews' monotheistic religion, but Antiochus was determined to impose Hellenism, with its pagan gods and its cult of the body, throughout his domains. When he met resistance in Judea, he made Judaism illegal.

Sabbath observance, circumcision, and the study of Torah were banned on pain of death. A statue of Zeus was installed in the Temple in Jerusalem, and swine were sacrificed before it. Some Jews embraced the new order and willingly abandoned the God and faith of their ancestors. Those who wouldn't were cruelly punished. Ancient writings tell the story of Hannah and her seven sons, who were captured by Antiochus's troops and commanded to bow to an idol. One by one, each boy refused — and was tortured to death before his mother's eyes.

The fight to reclaim Jewish religious autonomy began in 167 BCE. In the town of Modi'in, an elderly priest named Mattathias refused a Syrian order to sacrifice to an idol. When an apostate Jew stepped forward to comply, Mattathias killed the man and tore down the altar. Then he and his five sons took to the hills and launched a guerrilla war against the armies of the empire.

When Mattathias died, his third son, Judah Maccabee, took command. He and his band of fighters were impossibly outnumbered, yet they won one miraculous victory after another. In 164 BCE, they recaptured the desecrated Temple, which they cleansed and purified and rededicated to God. On the 25th day of the Jewish month of Kislev, the menorah — the candelabra symbolizing the divine presence — was rekindled. For eight days, throngs of Jews celebrated the Temple's restoration. "All the people prostrated themselves," records the book of Maccabees, "worshipping and praising Heaven that their cause had prospered."

In truth, though, their cause hadn't prospered — not yet. The fighting went on for years. It was not until 142 BCE — more than two decades later — that the Jews finally regained control of their land. Geopolitically, that was the moment of real triumph.

But Chanukah isn't about political power. It isn't about military victory. It isn't even about freedom of worship, notwithstanding the fact that the revolt of the Maccabees marks the first time in history that a people rose up to fight religious persecution.

What Chanukah commemorates at heart is the Jewish yearning for God, for the concentrated holiness of the Temple and its service. The defeat of the Syrian-Greeks was a wonder, but the spiritual climax of the Maccabees' rebellion occurred when the menorah was rekindled and God's presence among His people could be felt once again.

Chanukah is the only Jewish holiday not found in the Hebrew Bible and the only one rooted in a military campaign. And yet its focus is almost entirely spiritual, not physical. For example, there is no feast associated with Chanukah, the way there is with Passover and Purim, the two other Jewish festivals of deliverance. Its religious observance is concentrated on flame, nothing more. And the menorah's lights may only be gazed at; it is forbidden to use them for any physical purpose — not even to read by.

The lack of a physical side to Chanukah is unusual but appropriate. For the Maccabees' war against the Hellenists was ultimately a war against a worldview that elevated the physical above all, that venerated beauty, not holiness; the body, not the soul. The Jews fought to preserve a different view of the world — one with God, not man, at its center.

Had they failed, Judaism would have died. Because they triumphed, the Jewish religion survived. And from it, two centuries later, Christianity was born.

Zionist Organization of America President Morton A. Klein released the following statement:

ZOA strongly urges the Obama administration to veto the falsehood-filled, viciously anti-Israel, anti-Semitic racist ethnic cleansing resolution that the UN Security Council is planning to vote on this afternoon.  The resolution was re-presented by New Zealand, Malaysia, Venezuela and Senegal today.   Egypt initially presented the resolution on behalf of the PLO and then withdrew it yesterday.  The resolution’s horrors are described in ZOA’s release yesterday, “ZOA Urges Veto of Disgraceful Anti-Israel UN Resolution on Jewish Communities,” Dec. 22, 2016, and “Eight Anti-Israel Outrages Inside the UN Resolution on Settlements,” by Aaron Klein, Breitbart, Dec. 22, 2016. This Resolution sides with the Hamas Abbas terrorist regime that promotes murder of Jews, pays salaries to Jew killers families and honors them. 

President-elect Trump, Prime Minister Netanyahu, President-elect Trump’s excellent nominee for U.S. Ambassador to Israel David Friedman, Israeli envoy Danny Danon, U.S. Senator Schumer, U.S. Senator Mitch McConnell and many other members of Congress, the ZOA, and others have all been working hard to stop this horrendous resolution. 

In the strongest possible terms, we urge the Obama administration to reconsider its plans to allow passage of the hateful anti-Israel resolution today.  

Alarmingly, Reuters and CNBC both reported yesterday that diplomatic sources revealed that the Obama administration planned to allow the passage of this horrendous resolution.  (See U.S. Intended to Allow Passage of U.N. Draft Critical of Israel: Officials,” by Michelle Nichols and Lesley Wroughton, Reuters, Dec. 22, 2016; and “UN Vote on Resolution Against Israeli Settlements Delayed; Trump Had Called For Veto,”by Jacob Parmuk, CNBC, Dec. 22, 2016.)    Moreover, U.S. Secretary of State John Kerry planned to deliver a major speech attempting to justify the Obama administration’s anti-Israel UN move.  (See Reuters and NBC News Say Obama Administration Would Not Have Vetoed Resolution,”by Eric Cortellessa, Times of Israel, Dec. 22, 2016.)  

The ZOA strongly condemns the Obama administration’s despicable “lame duck” plan to knife Israel in the back at the UN, by abandoning longstanding U.S. policy of vetoing anti-Israel resolutions.   The real problem with the resolution is not simply that it is “one-sided”; the real problem with the UN resolution is that it is full of blatant anti-Israel, anti-Israel, racist falsehoods and pushes racist “Judenrein” (no Jews allowed to live here) policies.  

The anti-Semitic, inhumane UN resolution seeks to remove 700,000 Jews from their homes in the internationally-designated Jewish homeland in Judea/Samaria and eastern Jerusalem (the old city, where the holiest Jewish sites are located and Jews have lived throughout the millennia with the exception of the 19-year illegal Jordanian occupation from 1948-1967).

The resolution also seeks to overturn longstanding binding international law and longstanding U.S. policy by declaring that Israel’s lawful presence in these lands is “illegal”; and demands that Israel should return to the indefensible 1949 Armistice lines that have no international legal standing.  (The 1949 Armistice lines are where the fighting stopped after 6 Arab nations invaded Israel in 1947-1949.  The Armistice agreements specifically stated that the lines were “without prejudice.”  Abba Eban aptly called the lines “Auschwitz lines.”)    The resolution also calls for discrimination against Jews living in eastern Jerusalem and Judea/Samaria, among other horrors.  (See ZOA Urges Veto of Disgraceful Anti-Israel UN Resolution on Jewish Communities,” Dec. 22, 2016, and “Eight Anti-Israel Outrages Inside the UN Resolution on Settlements,” by Aaron Klein, Breitbart, Dec. 22, 2016, for further details.)

In sum, the Obama administration’s planned refusal to veto this resolution is a betrayal of longstanding U.S. policy and another knife in the back of America’s most reliable ally in the Middle East.  The administration’s Hanukkah/Christmas “present” will harm Jews, Christians and all the other minorities (including Muslims) who benefit from the religious and other freedoms and access that only Israel grants to persons of all faiths. 

ZOA observed and has been warning for several months that the Obama administration was orchestrating an extreme, harmful anti-Israel UNSC resolution.  In ZOA’s Nov. 3 New York Times Ad entitled “After Elections Will Obama Betray Israel at the UN?,” ZOA described numerous warning signs, including a Wikileaks document written by a former White House official revealing the administration’s plans; and the U.S. State Department’s baseless and vicious condemnations of Israel for building 98 apartments within a Jewish community, which accused Israel of not acting like a “friend” and said that the U.S. was “reconsidering” its “future engagement.”  Obama administration “echo chamber” editorials simultaneously appeared in the New York Times and elsewhere (reminiscent of the “echo chamber” that the Obama administration used to push the catastrophic Iran deal) – which echoed the State Department’s unwarranted condemnation of Israel and called for anti-Israel UN resolutions.   In an extraordinarily telling (and petty move), the White House crossed out the word “Israel” from former Israeli Prime Minister Shimon Peres’s burial place.  President Obama outrageously and falsely intimidated that Israelis were “enslaving” Palestinian Arabs during Obama’s eulogy of Peres. 

In the strongest possible terms, we urge the Obama administration to reconsider its plans to allow passage of the hateful anti-Israel resolution today.

  • "We will not recognize Israel because it will inevitably go away. And we will not backtrack on the option of armed struggle until the liberation of all Palestine." — Khalil Al-Haya, Hamas senior official.

  • The abandonment of Gaza by Israel in 2005 drove the Palestinian vote for Hamas the next year. It also explains why many Palestinians continue to support Hamas -- because they still believe that violence is the way to defeat Israel.

  • Hamas believes that Israel does not have the right to defend itself against rockets and terror attacks. It even considers Israel's self-defense as an "act of terror."

  • In yet another sign that exposes Hamas's ongoing preparations to attack Israel, the movement last week held a drill with live ammunition in the northern Gaza Strip.

  • "What has been achieved so far is a small jihad, and the big jihad is still awaiting us." — Palestinian Authority President Mahmoud Abbas. Abbas is convinced that his "diplomatic jihad" against Israel is no less effective than Hamas's jihad of terrorism.

  • Yet even if Abbas manages to achieve reconciliation with Hamas, this move should not be seen as sign of pragmatism on the part of the Islamist movement. Under no circumstances will Hamas relinquish its policy of the destruction of Israel and its replacement with an Islamist state.

  • From Abbas's point of view, Hamas's terrorism will only increase the pressure on Israel to capitulate. Here Abbas has an ally in Hamas: to multiply jihads to force Israel to its knees.

The UN and the Arab States Are Responsible for the Misery in the Shuafat Refugee Camp

A recent lengthy article in the New York Times Magazine described life in Shuafat, a slum located within the borders of Jerusalem but outside the security barrier that, over the past decade, has greatly reduced the ability of terrorists to strike Israel. Shuafat’s poverty stems in part from its being outside the jurisdiction of both the Israeli government and the Palestinian Authority and in part from its being administered by the United Nations, whose mandate is to perpetuate the suffering of its Palestinian residents. Jonathan Tobin writes:

People are in Shuafat and every other Palestinian refugee camp because the Arab world and its leaders and organizations have kept them there for some 68 years. In the years that followed World War II, . . . the United Nations set up two separate refugee agencies: one—UNRWA—that was solely devoted to the Palestinians and one for [the millions of other refugees] in the world. The latter was successful in caring for and finding new homes for its charges. UNRWA kept the Palestinians in the camps, and the Arab nations and Palestinian groups have ensured that this remains the case up until the present day. The sole purpose of keeping the refugees and their descendants—who now number in the millions—in place was to use them as a weapon against Israel. They sit in camps like Shuafat still being told that someday they will return to their old places of residence when Israel ceases to be a Jewish state.

That the camps have become awful slums is a function of the refusal of the world body, or the Arab world, to contemplate any solution other than the so-called “right of return,” which would mean the destruction of Israel. That they are not only poverty-stricken but hotbeds of anti-Israel extremism and terror is hardly surprising. In Shuafat’s case, the residents’ plight was worsened by the terrorist war of attrition launched by Yasir Arafat, which forced Israel to erect a barrier that succeeded in stopping the suicide bombings. . . .

Israel may be accused of lacking sympathy for the refugees, but it lacks the power to improve conditions in Shuafat or other camps in the West Bank, let alone Hamas-run Gaza. The responsibility belongs solely to UNRWA and the Palestinian leadership, both of which remain content to continue the same cynical policies. . . . When biased media ignore this fact, the biggest losers are the refugees.

Will the Palestinian Authority Pay Salaries to Arsonists?

Mahmoud Abbas received much praise for sending teams of Palestinian firefighters to help their Israeli counterparts put out the wave of fires sweeping through Israel. But, as Itamar Marcus points out, this gesture means little if the PA rewards the terrorists who started the fires in the first place:

According to Palestinian law, . . . anyone imprisoned [by Israel] for “resisting the occupation” receives a high monthly salary. Therefore, all of those convicted and imprisoned for arson will receive PA salaries “from the day of arrest until the day of release.” . . . Today there are approximately 7,000 Palestinian prisoners on the PA payroll. The PA rewards them every month for terrorism, and this generous arrangement will cost the PA NIS 488 million in 2016 alone, according to the PA’s publicized budget.

If Abbas was ever serious about stopping the PA’s ongoing support for terrorism, he now has the perfect opportunity to make a difference. Instead of merely enjoying complimentary headlines and nice photo-ops of Palestinian firemen with Israelis, Abbas should decree that the arsonists will not receive PA salaries. . . . Should Abbas insist on adding the imprisoned arsonists to the PA payroll, his hypocrisy in sending a few fire engines to Israel will be exposed to the world.

Should Abbas decide to deny salaries to the arsonists, this may indicate the beginning of a fundamental change in the PA attitude toward terrorism. However, if Abbas cancels salaries only to the arsonists, it will not be enough. If he says to the world that the PA will not pay salaries to those who burned trees, rocks, and homes while it continues to pay salaries to murderers of men, women and children, his values and behavior, which cause many to see him as a terrorist leader, will remain unchanged. . . . Right now while he has the world’s attention, having made this small gesture in the direction of peace, let him take a serious step.

  • For decades, UN agencies have slandered the Jewish state, most recently with the April 2016 accusation that it has been "planting Jewish fake graves" in Palestinian territory, and with UNESCO declaring last year that the ancient Jewish Biblical sites Rachel's Tomb and the Cave of the Patriarchs are actually Muslim holy sites, and last month that the Temple Mount, where the Jewish Temples were destroyed in 587 BCE and 70 CE, is an Islamic site with no connection to Judaism.

  • West Bank: This territory was for millennia called Judea and Samaria. After the 1948 War of Independence, Transjordan annexed it, renamed it the "West Bank," and occupied it for nearly two decades. In the Six Day War, after Jordan attacked Israel, Israel entered the territory and administered it until the Oslo Accords era, when Israel turned over much of the area to the Palestinian Authority.

  • Occupation: When it comes to Israel, the UN is obsessed with the word "occupation." A recent Wall Street Journal article documents 530 General Assembly references to Israel as an "occupying power" versus zero for Indonesia (East Timor), Turkey (Cyprus), Russia (Georgia, Crimea), Morocco (Western Sahara), Vietnam (Cambodia), Armenia (Azerbaijan), Pakistan (Kashmir), or China (Tibet)....Saying that Jews are "occupying" Judea is as nonsensical as saying Arabs are "occupying" Arabia or Gauls are "occupying" France.

  • Settlement: The UN uses the term to insinuate Israeli theft of "Palestine." The Obama administration eagerly embraced this terminology. If there is an occupying force in Gaza, it is Hamas. The West Bank is "disputed territories" to anyone claiming a modicum of neutrality. As Elliot Abrams put it, "the term 'settlement' loses meaning when applied to Jews building homes in their nation's capital city."

Israel's Terror Fires Teach Us a Lesson About a Conflict That Isn't About Real Estate

The wave of terror fires that swept through Israel that worsened natural blazes illustrates the depth of Palestinian hostility to Jews and Zionism.

The primary culprit for the wave of fires that swept through Israel in recent days was nature, not a criminal mind or the unpreparedness of first responders. But by the end of last week it was equally apparent that wildfires were spreading not solely due to the winds and dry conditions but as a result of politically inspired arson. Some 32,000 acres of natural brush and forests were destroyed in the Judean Hills near Jerusalem, as well as in the Haifa region. Hundreds of Israelis were injured (though thankfully none killed) and hundreds of homes were destroyed as tens of thousands were forced to evacuate as the fires spread. But as bad as the original fires that were the result of the weather were, they were made worse by what security officials say was an arson spree by Palestinians from the West Bank and some Israeli Arabs. The authorities reportedly detained at least 35 suspects in connection with the fires. Palestinian social media also seems to have played at least a small part in encouraging the fires that were celebrated by many Arabs.

As scary as the notion of terrorists using fire rather than explosives might be, it would probably be a mistake to characterize what happened last week as an organized “arson intifada.” Along with the assistance provided to Israel by friendly countries such as the United States, the Palestinian Authority also sent crews to help put out fires that could spread to territory under its control as well as assisting Israel in dealing with an arson fire at one West Bank settlement. There is no evidence of a concerted effort on the part of Hamas or Fatah to start the fires. Rather, like the so-called “stabbing intifada” that afflicted Israel over the course of the last year (and which appears to have died down), the willingness of dozens of individuals to start fires they hope will injure Jews or destroy their property is more the result of a Palestinian political culture in which hate and violence directed at Israelis is both encouraged and praised.It is appropriate for Israeli leaders to make it clear that Jews will not be burned out of their country anymore than they can be bombed out of it. This isn’t the first instance of Palestinians using arson as a terror tactic and it probably also won’t be the last. But while no one should underestimate the determination of Israelis to stand fast in the face of terror, the lesson of the last week is that there is that the conflict between two peoples over one land is still so bitter that many Arabs appear to be still willing to destroy it rather than let Jews live there in peace.

A series of feckless decisions by Obama to reduce American military influence abroad have created geopolitical power vacuums that are being filled by countries and ideologies that are innately hostile to Western interests and values.

  • For the past seven decades, the U.S. has spent millions of dollars annually to guarantee German security, although Germany steadfastly refuses to honor a NATO pledge to spend 2% of GDP on defense spending. Germans are now offended that Trump is asking them to pay their fair share for their own defense.

  • Although President Obama's foreign policy missteps have made Europe much less safe than it was eight years ago, European elites have overlooked Obama's mistakes because he is a "globalist" who seems to favor recreating the U.S. in the European image. Trump, by contrast, is a nationalist who wants to rebuild the U.S. in the American, not the European, image.

  • European anti-Americanism is certain to escalate in the years ahead, not because of Trump or his policies, but because "globalists" appear desperate to save the failing European Union, an untransparent, unaccountable, anti-democratic, sovereignty-grabbing alternative to the nation state.

In Germany, Der Spiegel, one of the largest-circulation publications in Europe, published a cover, after Donald Trump's election victory, with an image of a giant meteor in the shape of Trump's head hurtling towards the earth. The headline reads: "The End of the World (As We Know It)".

European anti-Americanism — which was on the wane during the presidency of Barack Obama, who steered the United States on a course of globalism rather than nationalism — is back with a vengeance.

Europe's media establishment has greeted Donald Trump's election victory with a vitriol not seen since the George W. Bush presidency, when anti-Americanism in Europe was at fever pitch.

Since the American election on November 9, European television, radio and print media have produced an avalanche of negative stories, editorials and commentary that seethe with rage over the outcome of the vote.

  • In President Recep Tayyip Erdogan's view, Belarus is decent and peaceful, but Western Europe is not. Merely because Belarus's dictator, Alexander Lukashenko, agreed to open a mosque to lure some Turkish investment.

  • Back in Turkey, things look very Belarusian -- even worse -- rather than Western European, a culture Erdogan despises.

  • President Erdogan's crackdown on dissent goes at full speed. Asli Erdogan, a peace activist and novelist, worked for Ozgur Gundem, a pro-Kurdish newspaper. She has remained in prison since her August arrest. The prosecutors demand an aggravated life sentence plus 17.5 years in jail for her. How did Asli Erdogan, the novelist, "support terror"? This is from the indictment: "... in an understanding of a novelist [the accused] portrayed terrorists as citizens in her columns."

  • "In the history of the program, there has never been such an extraordinary situation where I think we can say that a democracy is threatening to turn itself into a dictatorship." — Frank Schwabe, German Social Democratic lawmaker and human rights expert.

  • Europe's unpleasant game with Turkey should end at once, with Brussels and Ankara admitting that the planned marriage was an awfully bad idea from the beginning.

Reading his public speeches, one may think that Turkish President Recep Tayyip Erdogan must be joking; that he is a celebrity stand-up comedian, the best in his profession. In reality, he is not joking. He believes in what he says. And he does not want to make people laugh. He is just an Islamist strongman.

Visiting Minsk, the capital of Belarus, in the first week of November for the opening of a mosque in a dictatorial country where there are 100,000 Muslims, Erdogan accused Western Europe for "intolerance that spreads like the plague."

Erdogan described Belarus, which Western countries describe as a dictatorship, as "a country in which people with different roots live in peace." In Erdogan's view Belarus is decent and peaceful, but Western Europe is not. Merely because Belarus's dictator, Alexander Lukashenko, agreed to open a mosque to lure some Turkish investment.

DNC may elevate Congressman Ellison to Chief of DNC???

 If you thought the Democrats would respond to Donald Trump’s stunning victory in the 2016 presidential election by attempting to woo back some of the white blue-collar voters they lost over the last eight years, you’re sadly mistaken: they’ll be doubling down on the Obama coalition.

The proof: on Friday, support built dramatically among Democratic insiders like incoming Senate Minority Leader Chuck Schumer (D-NY) for Rep. Keith Ellison (D-MN) as head of the Democratic National Committee.

Ellison is a black Muslim from Minnesota – not exactly a reflection of the crowd the Democrats lost in 2016. He’s also a radical leftist on economic policy, endorsed by socialist Senator Bernie Sanders. As Jack Heretik of Free Beacon points out, “He supported impeaching then-Vice President Dick Cheney, compared President George W. Bush to Hitler, and blamed Bush for the September 11 attacks.” He’s radically anti-Israel, too; he compared Israel to South African apartheid, and wanted Israel to grant concessions to the terrorist group Hamas. Ellison was linked to the anti-Semitic Nation of Islam, and as The Weekly Standard reports, “he himself mouthed those views.”

This all presages a move by the Democratic Party to tack toward the full-on racial polarization President Obama cultivated during his tenure. Democrats, disappointed by their election results in 2016, will undoubtedly deepen the narrative that Republicans are racist, xenophobic, and Islamophobic, and attempt to nominate a person of minority ethnicity in 2020 in order to cultivate that narrative further. Doing so, they think, will draw out a heavier minority turnout, driving them back to victory. They’re banking on the changing demographics of the country – as I wrote yesterday at National Review:

[T]he white vote represented 72 percent of the vote in 2012, compared with just 70 percent in 2016; the black vote represented 12 percent in 2016, down from 13 percent in 2012; the Latino vote inched up to 11 percent of the electorate from 10 percent in 2012. Trump did better than Romney among Latinos (he lost them 65-29, compared with 71-27 for Romney) and blacks (lost 88-8, compared with 93-7 for Romney) and young people (lost 54-37, compared with 60-37). Shift any of those numbers slightly and Trump loses the election. In 2020, Millennials will represent nearly 40 percent of eligible voters, and Latinos will represent 15 percent of the electorate; blacks will likely remain steady.

As hard reality and not far-fetched fantasies about peace resulting from a "two-state solution" become more mainstream within Israeli society and the body politic, we are hearing more and more calls for annexation of Judea and Samaria, either in its entirety, or in part.

As reported in Arutz Sheva, Education Minister Naftali Bennett (Jewish Home) has just called upon the Israeli government to annex Judea and Samaria, extending Israeli law to the 450,000 citizens living there ('Don't fret global opposition, annex Judea and Samaria now'.)

Bennett made his statement following several anti-Israel resolutions passed by UNESCO, denying any Jewish connection to Jerusalem, the Temple Mount, and even the Kotel, the Western Wall.

"It's time to apply Israeli law on Judea and Samaria. We're 50 years on in Judea and Samaria and Jerusalem [since the Six Day War]. It's time that 450,000 Israelis are treated equally. They serve in the army, they pay taxes, they're part and parcel of Israel. It's time for normalcy. It's time to apply Israeli sovereignty on Judea and Samaria." 

Bennett added that while he understands the concerns some Israelis feel regarding the possible international backlash to such a move, there are precedents for annexation.

"Menachem Begin in 1981 did the same thing for the Golan Heights. Eshkol in '67 did the same thing in Jerusalem. And there was always a world [that opposed it]. But there was the will power and the courage to do it, and we need to do what's right for Israelis, for the Jews, and that's the right thing."

Regarding recent UNESCO resolutions dismissing Jewish historical ties to Jerusalem, the Education Minister said the root of the problem was the failure of Israel to clearly express Jewish rights to the historic Land of Israel.

"That's what happens when we don't treat our own land as ours. The UNESCO resolution is an attempt to deny history. But you know what? You cannot change history. Israel is ours for well over 3,000 years. It will be ours - Jerusalem is ours - but it's time to apply Israeli law to Judea and Samaria."

At the same time, a rally was held in front of the Knesset, demanding that Israel annex Ma'aleh Adumim, as a way to preserve a united Jerusalem. The community is only a ten minute drive from Jerusalem.

Several notable Members of Knesset attended the rally and made the following statements:

Tzipi Hotovely: "The answer to the international battle over Jerusalem is to impose sovereignty over Ma'aleh Adumim, to ensure a united and developing Jerusalem."

Yoav Kisch: "We are continuing the path of past Israeli leaders who stood at the forefront of Zionism for all its years. Now its our turn to be Zionist leaders." 

Shuli Moalem-Refaeli: "The time had come for Ma'eleh Adumim residents to have the same rights as those who live within Israel's sovereign borders."

Bezalel Smotrich: The annexation talk is not a "warning campaign" but an initiative that would succeed. "The time has come to be normal."
 

But naturally, the world is against this idea and wants to shrink Israel back to the indefensible pre-1967 armistice line: UN investigator to Israel: Give PA complete control of Area C.

Candian UNHRC investigator Michael Lynk stated that Israel must give full control over Judea and Samaria to the Palestinian Authority.

"Allow the Palestinian Authority to assume security control in Area B and civil and security control in Area C so as to end the geographic fragmentation of the occupied Palestinian territory," Lynk said.

We prefer to oppose Lynk's statement and agree with MK Smotrich, who said simply yet profoundly, "The time has come."

Is There An Occupation?

In order to believe Israel is occupying “Palestinian land” you have to believe there is such a thing as “Palestinian land”.

You have to believe there is a Palestinian Arab nation which is a  distinct people with its own history which has existed for centuries.

You have to believe Palestinian culture exists without any recorded archaeological evidence, works of literature, music, distinct foods, linguistic connections to the land, religious observances tied directly to the land and a host of other problems with their claims to be Indigenous.

To believe in an Israeli occupation of “Palestinian land” you have to believe the same, insane, UNESCO/Palestinian “history” or “narrative” as the one which says the Jewish Temple Mount is not sacred to Jews. Narrative is just a fancy word meaning “made up stuff”.

You have to believe this Palestinian people have a distinct culture that is “Palestinian” and separate from wider Arab culture, different from Arabs in Jordan or Syria or Sinai or any of the other parts of the Arab world. Despite the fact even the name they adopted for themselves is not Arabic in origin and begins with a letter not even in their alphabet.

And because this “Palestinian narrative” is so obviously an identity theft of the impregnably strong Jewish indigenous identity, you have to also disbelieve all evidence of Jewish history in the Holy Land. You also have to negate Christian ties to Israel, by the way.

You have to be blind to the fact so many Arab surnames and identifiers proudly proclaim their origins from all across the Arab world and not from within this land of Israel. It is an obvious signifier because a majority of the Arabs now living in Israel are descendants of those who moved here prior to 1948 as the Jews slowly returned in greater numbers and started to repair the land after centuries of malaise and decay under a succession of Islamic caliphs, sultans and pashas.

You also have to go out and look at Judea and Samaria and notice how much undeveloped space there is. There is a lot of room for coexistence if people wanted to co-exist. We co-exist in Tel Aviv and Jaffa and Haifa. We could co-exist in Judea too.

What we do have is a large number of Arabs who are raised with hatred of Jews and told their destiny is to take over all of Israel. They are convinced of this. From the river to the sea they chant. As long as these two lies are being firmly implanted in Arabs in the territories, Israel will need to treat them carefully to stop our people being killed. The conditions we impose on them should be the kindest we can, without risking our own lives.

There is a very big difference in mindset between those Arabs who accepted Israeli, Jewish sovereignty in 1948 and those who didn’t. The fault line is Jerusalem. The wrong answer (for everyone) is to continue perpetuating the myth of occupation. As long as some Arabs are encouraged by outsiders and left-wing Israeli fools to believe Jews will one day leave our land, they’ll keep fighting to make that happen.

In some ways, however, it is fortunate they’re fighting us as if we are an occupying power, rather than a returned indigenous people. Their tactics of wearing us down would work to expel Americans from Afghanistan or the British from pretty much everywhere, but they can’t make the price of holding on to Jerusalem too high for Jews. Some of us will never get tired, enough of us will fight to the last. We will always be here because we know this is our land and we’ve learned the lessons of expecting anywhere else will ever be safe for us.

There is a declining fringe of Israeli society that will cry about the conditions we must impose on Arabs for our security. This fringe feel their influence within Israel declining, they lose elections, their newspapers fail. That is why they flee Israel to spread their message. They flee into the arms of the willing Jew haters of the global left, those dreaming of an Islamic caliphate which joins an extreme fringe who still believe in the lies of the Protocols of the Elders of Zion. Those who erroneously believe Zionism is something global rather than the return of an indigenous people to their land. People like Hagai El-Ad of B’Tselem (just as one example) who runs to speak to the UN and raises money outside Israel because he is so irrelevant to Jewish Israel.

There is no occupation. There is just a struggle to defeat an ideology that believes it must be superior, it must not be ruled by Jews and it can’t accept the humiliation of once enslaved dhimmi Jews regaining their sovereignty and reversing the course of Islamic conquest and Jihad.

There is a long, complex and not very well decided legal discussion over the correct use of the term “occupying power” as it relates to the Geneva Conventions. Most people talking about occupation today aren’t international lawyers so I’m setting aside the true academic and legal terms here. If you want academic and legal, pay attention to Eugene Kontorovich because it is by no means certain that what we have in the disputed territories is a clear case of anything.

Does this now mean that some religions are more equal than others?

  • On Halloween night, only the "Sexy Nun" is available, while "Caliph" Baghdadi can rape his Yazidi and Christian sex slaves with impunity.

Spot the offensive costume -- or the hypocrisy. Online retailer Amazon removed the "Sexy Burka" costume (left) after accusations of "Islamophobia." But despite the protests of many Catholics customers, the "Sexy Nun" (right) is still on sale at Amazon.

The world's biggest shopping portal, Amazon, sells many Halloween costumes. One of the novelties in 2016 has been the "Sexy Burka", the typical obscurantist cloak that the Taliban and the Islamic State impose on women. But the sexy burqa, which on Amazon UK was priced at £18.99, did not last long.

The commercial colossus of Jeff Bezos removed the item from the website, after Amazon had been swamped with accusations of "racism", "Islamophobia," of marketing an Islamic garment with the white face of a model and using "a religious garment for commercial purposes". "You are disgusting, my culture is not your costume", wrote many users of the Islamic faith. Others used a less adorable tone: "Whoever you are, you should fear Allah. This is not a joke."

Turkey Targets Christians

  • In the last four years, more than 100 Christian pastors and other religious officials have been deported from Turkey, and banned from reentering.

  • "When Jesus reached 30 years of age, Allah gave him the duty of being a prophet. He then began inviting people to believe in Allah." — Turkish textbook on Christianity.

  • "[R]eligious minority students are faced with the option of taking the class or sitting alone somewhere else on the school premises during the classes, thus separating them from their peers and singling out their religious differences." — U.S. Commission on International Religious Freedom, Turkey Textbook Report.

  • It is high time that the activists of the global "human rights community" condemned or at least publicly discussed this "culture of hate" in the Muslim communities -- and particularly the Christianophobia.

American pastors in Turkey are being arrested hand over fist.

American Pastor Andrew Brunson, of the Resurrection Protestant Church, was arrested in Izmir (Smyrna)on October 7 alongside his wife, Norine Lyn Brunson, for "threatening the national security of Turkey." Brunson is expected to be deported in 15 days. The couple is still being held in detention.

Turkish authorities also seized the residence permit of Ryan D. Keating, an American student pursuing a PhD in the philosophy of religion at Ankara University. Keating is a Christian who heads the Ankara Refugee Ministry for the Kurtulus Church. While he was leaving Turkey for work purposes, he was told at the airport that his residence permit in Turkey had been cancelled in September for "national security", meaning that he will not be able to reenter the country. His wife and children are still in Ankara.

  • The Obama administration has taken in 5,435 Muslim refugees, but only 28 Christians -- even though Christians are approximately 10 percent of Syria's population and are classified as experiencing a genocide there.

  • The logic of the pope's statement seems to be that violence done that contradicts the Judeo-Christian God's commandments -- such as the murder of wives and mothers-in-law -- is identical to violence done in accord with Allah's commandments to wage jihad on "infidels."

  • One million Christian children whose families have been displaced or affected by the violent activities of Boko Haram and Muslim Fulani herdsmen are starving. Boko Haram's seven-year rebellion has left 20,000 people dead and more than two million displaced. — Nigeria.

  • One social media posting by the Islamic State showed a picture of a young girl with the caption: "Virgin. Beautiful. 12 years old... Her price has reached $12,500 and she will be sold soon."

Father Jacques Hamel was murdered in France on July 26, in the church of Saint-Étienne-du-Rouvray, by Islamic jihadists.

As the Muslim persecution of Christians continues to reach critical proportions around the world (see report below), the average American shows much more concern than the current administration. Soon after it was revealed that the Obama administration has taken in 5,435 Muslim refugees, but only 28 Christians -- even though Christians are approximately 10 percent of Syria's population and are classified as experiencing a genocide there. A poll found that more than three-quarters of American respondents agreed with the statement: "It is important to me that the next US President be committed to addressing the persecution that some Christians face around the world (e.g.: imprisonment, beheadings, rape, loss of home and assets)."

Long, but important update:

During this Sukkot we have had two important developments that I wanted to share with you:

  1. B’Tselem’s National Service positions
  2. Hebrew University’s Minerva Center for Human Rights

B’Tselem and National Service

For years Im Tirtzu has been working to raise awareness to the fact that radical Israeli organizations, which receive millions of dollars in foreign government-funding, enjoy National Service positions courtesy of the Israeli government.

Several weeks ago we even worked with MK Amir Ohana (Likud) who put forth a bill aimed at halting this absurdity based on the understanding that the current laws do not provide the tools for cancelling National Service in such organizations. In addition to raising awareness and promoting new ideas with MK Ohana, we were also pleased to see how other Zionist organizations joined the fight and started campaigning against National Service in these radical NGOs.

The new and important development here is that in response to B’Tselem CEO Hagai El-Ad’s anti-Israel speech at the United Nations Security Council, Prime Minister Netanyahu announced that he will work to see that B’Tselem will no longer receives National Service positions.

If we were pleased several months ago when PM Netanyahu spoke out against the involvement of foreign governments in the effort to delegitimize the country from within, his stance towards B’Tselem’s National Service positions is equally important in terms of our ability to introduce messages to Israeli society and to influence public discourse.

We will continue to work hard on this issue.

Minerva

Recently, we have exposed that a large amount of radical organizations have infiltrated into Israeli academia via joint academic programs with external elements. Among these organizations are B’Tselem, Baladna, and HaMoked, which defends terrorists and their families in court. Meaning, a student can receive academic credits and scholarships for interning in political organizations that work against the state.

One of these such programs is operated by Hebrew University’s Minerva Center for Human Rights. Since bringing this issue to the attention of the Israeli public last week, we succeeded in rousing many important people to act.

Deputy Foreign Minister Tzipi Hotovely announced that she is stopping the Ministry’s funding and collaboration with the Minerva center.  

A large number of bereaved families who work with Im Tirtzu against radical foreign government-funded organizations that defend terrorists,sent a letter to Minister of Education Naftali Bennett echoing our demand to halt funding and accreditation for such programs.

Additionally, a number of attorneys turned to the Attorney General with the request to open an investigation on the suspicion that the scholarships for these programs are given illegally tax-free.

The "other side"

These two things, National Service in anti-Israel organizations and the penetration of radical NGOs in academia, are important issues for Im Tirtzu as well as for the “other side,” meaning the New Israel Fund and its organizations.

Attached to this email is a poster published by B’Tselem following the speech of their CEO at the UN, reading: “We are not afraid of ‘Im Tirtzu’ but from another 50 years of occupation.” This poster emphasizes how well B’Tselem understands the ability of Im Tirtzu to create and galvanize the Israeli public and decision makers.

The second picture that is attached is a Facebook post by the New Israel Fund, which in one breath talks about both of the subjects that we are working against (Minvera and B’Tselem)

Claude Lanzmann: Spectres of the Shoah explores the arduous 12-year journey that led to the creation of the French iconoclast’s “Shoah,” a nine-hour-plus examination of the Holocaust. Marking the 30th anniversary of the landmark documentary, the film features previously unseen outtakes and reflects on key moments in the 90-year-old auteur’s life, revealing his hopes and expectations for the future. Directed by Adam Benzine. The Shoah outtakes comprise the Museum’s Claude Lanzmann Shoah Collection, one of the richest sources of Holocaust history. The Museum’s more than $1 million investment has preserved about 70 percent of Lanzmann’s 220 hours of picture and sound reels, which are now fully available for research and freely accessible on the Internet. The Museum is committed to improving access to these interviews, which have great significance for scholars, documentary producers, and the wider public.

One of the ways the New York Times shows its bias against Israel is with decisions on the placement of stories. The latest example comes with the newspaper’s decision to print a news article, above the fold on page one, about a flap between the Obama administration and the Israeli government over a West Bank settlement. I’d argue that this doesn’t really amount to “news” much at all.
